SGB World Terms of Use
§1 Definitions
1. Terms of Use shall be understood as these Terms of Use in their entirety.
2. SBG World shall mean the website available at www.sgb-world.com along with all functions and tools made available through the Website, with its registered seat in Solidarności 115 St,. room no. 2, 00-140 Warsaw, Poland.
3. Administrator shall mean an individual designated by SGB World responsible for running, maintenance and support of the Website as well as ensuring all Users comply with the Terms of Use.
4. User shall mean any natural person of legal age, any legal entity or any organizational entity without legal personality having legal capacity under applicable law, who registers and is granted access to the services provided by SGB World at www.sgb-world.com website.
5. Account shall mean a personal account on the Website, accessible to every User after logging in (using an email address and a password), through which the User can use the Services provided by the Website.
6. Profile shall mean a website page at SGB World where User information, including personal data provided by the User pursuant to the terms and conditions of the Terms of Use, is stored and published.
7. Information shall mean the content provided by the Users of the Website, including photographs (images), movie clips, advertisements, etc. published on the Website.
8. Service/Services shall mean all operations provided by the Administrator to the benefit of the Users, performed in accordance with the provisions of the Agreement. Some Services available via the Website may be chargeable.
9. Chargeable Services shall mean any Services offered by the Administrator via the Website, performed for a fee voluntarily paid by the User. Chargeable Services shall be clearly marked as chargeable on the Website with a relevant description.
10. Database shall mean a set of Data or Personal Data provided on the Website by the Users in relation to the Services provided by SGB World.
11. Agreement shall mean the electronic services agreement concluded by and between the User and the Administrator upon the User’s acceptance of these Terms of Use and registration at www.sgb-world.com.
§2 Technical Requirements
In order to be able to use the Website and Services, the User should have an active email account and the latest version of one of the following Internet browsers installed: Firefox, Safari, Opera, Internet Explorer (v8.0 or higher) or Google Chrome. It is allowed to use other versions of Internet browsers.
§3 General Provisions
1. Registration and using www.sgb-world.com is free of charge.
2. The User agrees that upon registration, the Website shall start providing Services to the User.
3. The Administrator shall provide Services on the basis of these Terms of Use.
4. The Agreement with the User shall become effective upon acceptance of these Terms of Use and registration at www.sgb-world.com. The Agreement is concluded for an indefinite period of time. The Agreement shall expire upon deletion of the User’s Account or – in case of Users who are natural persons – upon death of the User.
5. The Website Administrator allows Users to publish and browse the contents of the Website, search Users, exchange opinions, send private messages, participate in board discussions, make new acquaintances as well as perform other activities allowed by the Website and use Chargeable Services.
6. Posting materials or information deemed to be spam (unsolicited commercial communication) as well as posting contents which infringe on personal rights, human dignity and rules of social conduct is strictly forbidden. These shall include materials, information and contents that:
a) are of vulgar and offensive nature, promoting violence, hatred and discrimination,
b) are of racist nature, inciting racial and religious persecution, containing pornography and nudity,
c) are illegal and morally reprehensible,
d) breach copyright and authors’ property rights,
e) advertise psychoactive substances (including alcohol).
7. The User agrees to:
a) refrain from acting to the detriment and destabilization of functioning of SGB World, Website Users and Third Parties,
b) comply with the provisions of the law in force, including copyright law, property law, etc.,
c) respect the privacy of other Users, and in particular to refrain from collecting, processing and distributing Information regarding other Users and Third Parties without their consent.
8. The Administrator reserves the right to verify the identity of the User, e.g. by requesting the User to submit a photocopy of a personal ID. Submitting the foregoing document is strictly voluntary; however, refusal to submit it may result in being denied the provision of Services by the Administrator. At the same time, the Administrator undertakes to destroy the photocopy of the document after verifying the Data.
9. While using some Services is free of charge, other Services may be chargeable. Chargeable Services shall be clearly marked as chargeable on the Website with a relevant description.
10. In future, it is possible that new options and mechanisms, which are currently unavailable, will be launched on the Website. Using these new options and mechanisms may be free of charge or chargeable (as a Chargeable Service). The introduction and use of a new Chargeable Service shall be entirely voluntary and optional on the part of the User.
11. The Administrator reserves the right to change the price and properties of Services.
12. Each of the Parties may terminate the Electronic Services Agreement without giving cause or notice.
13. The Administrator reserves the right to delete the User’s Account, deny the User access to his/her Account, remove contents posted by the User or delay posting the User’s contents on the Website, especially when:
a) the User acts in breach of these Terms of Use or the provisions of the law in force, and in particular if the User infringes on the personal rights or copyright of other Users and Third Parties;
b) the User acts to the detriment and destabilization of SGB World functioning;
c) the User sends spam to other Website Users in a manner that is extremely bothersome to them.
14. In case the Administrator has any doubts as to the correctness or validity of the information provided by the User in his/her Account, the Administrator shall be empowered to take the following actions:
a) to demand the User to remove the incorrect data or validate them immediately, or
b) to block the User’s Account immediately until the matter is resolved.
15. The User understands that deletion of the User’s Account will result in complete and irreversible loss of all data stored under the User’s Account.
16. Each User is allowed to report any information that violates or is otherwise inconsistent with these Terms of Use to the Administrator (especially §3 item 6 and §3 item 7).
17. The Administrator may suspend the operation of the Website for maintenance or upgrade work from time to time. The Users shall be notified of this fact well in advance.
18. The Administrator undertakes to provide the Users with Services of the highest quality possible.
19. The Administrator shall not be held liable for technical problems or interruptions in the Website operation caused by a Force Majeure event, hardware failure or prohibited interference of the Users or Third Parties, even if such failure resulted in loss of data stored on Users’ Accounts.
20. The Administrator shall not be held liable for a temporary unavailability of the Website to Users due to system maintenance and upgrade works.
21. The User agrees to receive system messages, Administrator messages as well as potential interruption, modification and maintenance break-related notifications to the email address entered during registration.
22. The Administrator shall not be held liable for the contents distributed and published by the Users.
23. However, the Administrator reserves the right to edit, abridge or reject any information (including photographs) that are inconsistent with these Terms of Use, prohibited by the law in force or re-published simultaneouslyon the Website.
24. The User understands that by posting contents that are inconsistent with these Terms of Use and the law in force, the User may be held criminally and civically responsible towards the Administrator, other Users and Third Parties.
§4 Registering and Using the Website
1. Before starting to use all functionalities of the Website, the User must read these Terms of Use carefully. The Terms of Use establish the rules and regulations that apply to all Users of this Website.
2. By deciding to use the Website, the User accepts the provisions of these Terms of Use.
3. In order to register, the User must provide the following data: first name, last name, sex, date of birth, email address, username, password.
4. Upon acceptance of these Terms of Use, the User declares that:
a) the User will act in accordance with SGB World Terms of Use;
b) the data provided by the User in the registration form and the User’s profile are true and correct;
c) the User will keep the data given in the profile updated at all times.
5. The User agrees that upon registration, the Website shall start providing Services to the User.
§5 Resignation and User Account Termination
1. Each of the Parties may terminate the Electronic Services Agreement without giving cause or notice.
2. The User shall terminate the Agreement by delete Account on User's profile or requesting the Administrator(s) to delete the Account of the User. Such termination request should be sent to the following email address: This email address is being protected from spambots. You need JavaScript enabled to view it. , subject: “Resignation.” Termination request should be sent from the email address with which the User registered.
3. Upon submission of the Account termination request to the Administrators, the Agreement shall be terminated after a notice period of 72 hours.
4. SGB World shall terminate the Agreement by deleting the User’s Account by the Administrators.
5. The Administrator reserves the right to block the Account in case of the User’s non-compliance with the law in force and these Terms of Use.
6. Should the Account be blocked by the Administrator, creating a new Account shall require the Administrator’s prior consent.
§6 Personal Data and Copyright
1. SGB World is the administrator of the personal data provided by the User.
2. The administrator gathers information about the User and his/her behaviour through cookie files and through the data provided by the User.
3. The administrator shall process the personal data to the extent necessary to establish a service delivery relation, decide upon the content of services, modify, terminate and correctly perform electronic services as well as to settle payments with the User. Additionally, the administrator shall process the personal data for statistical and marketing purposes (article 6 (1) and points b, c, and f of the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC). Upon the User’s consent, SGB World shall process the User’s data to the extent greater than it is required upon registration.
4. SGB World shall process the personal data in accordance with the provisions of the law in force, and in particular with the provisions regarding personal data protection.
5. The User understands that deletion of the User’s Account will result in complete and irreversible loss of all Data stored under the User’s Account.
6. The User shall have the right to review the processed personal data at all times as well as to correct the data and request for the data to be deleted from the Database.
7. The administrator shall process the personal data until the deletion of the User’s Account or withdrawal the permission to process of the User's personal data. In this case, personal data will be deleted or anonymoused with the exception of some personal data (name and surname, e-mail, history of profile, and the User's granted permission) which will be processed 3 years in order to establish, bring, and defend against the claims.
8. In order to prevent the individuals who have been banned from using the Website due to non-compliance with the law in force and these Terms of Use from re-registering, the Administrator reserves the right to refuse to remove the personal data necessary to block any attempts to re-register. Refusal to remove data shall also be allowed in the cases provided for by the provisions of the law in force.
9. Personal data can be made available to Third Parties authorized to access such data pursuant to the provisions of the law in force only upon a written request of such parties. SGB World can also make the collected personal data available upon request or consent of the User or upon request of the state authorities authorized to access such data pursuant to the provisions of the law in force. Email correspondence sent to the Website shall be archived and, in certain cases, may be used as evidence for investigative purposes.
10. The User publishing his/her own original work on SBG World Website waives all claims against the Website.
11. By concluding the agreement with the Administrator, the User agrees to:
a) respect the copyright, property rights, rights under the registration of inventions, patents, trademarks, utility models and industrial designs of the Administrator, Users and Third Parties;
b) refrain from actions that might affect the privacy of other Users, especially actions consisting in collecting, processing and distributing information regarding other Users without their explicit consent, except for circumstances in which such actions are in accordance with the law in force and the provisions of these Terms of Use;
c) refrain from actions consisting in destroying, modifying, deleting, damaging and hampering access to other Users’ Accounts.
12. The User declares that any messages and contents, including photographs and personal data, published by the User on the Website, are true and do not infringe on the copyright or personal rights of others.
13. The User also declares that he/she has obtained the consent of other Persons to publish the posted contents, depicting or related to these Persons.
14. The User is authorized to use the data, images, materials or statements covered by copyright and related rights, as amended, published on SGB World Website for the User’s own personal purposes. Using the foregoing data, materials or statements for other purposes shall be allowed only upon consent of the person authorized to use them or upon the law in force and the provisions of these Terms of Use.
15. The User shall grant SGB World the right to use and distribute the data or statements published by the User in presentations and other materials as a part of a larger entirety, free of charge.
16. The Administrator shall not be held liable for the actions taken by the Users and Third Parties, nor for their use of the Users’ data outside the purposes of the Website’s operation.
17. The Administrator shall not be held liable for claims by Third Parties made in relation to publication of photographs or personal images of these Parties. The User who published the disputed photograph or image of a Third Party shall be held exclusively liable in this respect.
18. The User has the right to bring charges to the President of the Personal Data Protection Office (the President of the Personal Data Protection Officewhich is seated in Stawki 2, 00-193 Warsaw, Poland) when the User suspects that the User's personal data are not process with the provisions of the law in force.
§7 Complaints
1. The Policy explains the procedure of filling and handling complaints regarding SGB World Website.
2. SGB World reserves the right not to invetigate a complaint, should be complaint be the result of lack of knowledge these Terms of Use or the provision of the law in force.
3. All questions or complaints regarding the perforrmance of the Website and the Services provided should be sent to This email address is being protected from spambots. You need JavaScript enabled to view it. , subject: "Complaint".
4. The User shall have the right to withdraw from the Services provided by the Website within 14 days at the latest from the day of establishing the service delivery relation (i.e., from the submission of request for a certain Service via submission forms available at www.sgb-world.com). Notification of withdrawal from the Service should be sent to This email address is being protected from spambots. You need JavaScript enabled to view it. , subject: "Complaint". Resignation shall not be considered, if during the foregoing period the User activated the Service and the Website started to provide the Service, e.g. the Advertisement of the User was published.
5. Complaints can be filed within 14 days from the date on which a Service was or was supposed to be provided. Should this deadline not be met, complaint shall not be accepted.
6. Complaints shall be investigated within 14 days from the date of filling a complaint.
7. The Service Provider shall be entitled to full remuneration, even if:
a) the User decided to withdraw from the Services provided by the Website, but has not met the deadlines specified in these Terms of Use;
b) the User’s Account was blocked or deleted due to non-compliance with the provisions of the law in force and of these Terms of Use.
8. SGB World reserves the right to intervene in the User's Account in order to remove any irregularities in the performance of the Website or any disturbances or problems in the performance of the User's Account.
9. SGB World shall not be held liable for the services provided by the User and Third Parties involving the use of the functions of the Website.
10. Complaints filed against SGB World regarding the services provided by Third Parties via www.sgb-world.com Website shall not be investigated. The Website shall not be obliged to transfer the complaint to the entity responsilble for handling the complaint.
11. The complaint should contain the following:
a) details of the problem, including the name and price of the Service and a brief description of circumstances constituting the grounds for the complaint,
b) first name, last name and email address of the User to whom the Service was supposed to be provided,
c) first name, last name and email address of the User registered with the Website who paid for the Service,
d) first name, last name and email address of the Third Party who paid for the Service,
e) date of payment for the Service as well as other data and copies of documents necessary to identify the payment,
f) PayPal account or full number of the bank account to which the cost of the Service should be reimbursed, if necessary.
